General conditions
Scope and provider
The present general terms and conditions of sale are applicable to sales contracts concluded online via the https://la-touche-francaise.fr website between La Touche Française and its customers.
Conclusion of the contract
In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order, after having viewed the details of your order, and in particular its total price, and having had the opportunity to correct any errors.
Language
The language proposed for the conclusion of the contract is French.
Acceptance of the T&Cs
Before concluding a contract with us, you must read the T&Cs and accept them by clicking on the corresponding box in the order process.
Archiving
The contracts concluded on our website (data relating to your order and GTC in force on the day of your order) are archived for a period of 10 years. You can access the archived contracts by making a request through the contact form or by mail to :

Awards
VAT is included in the prices displayed on our site at the currently applicable legal rate. The prices mentioned on our site are indicated including all charges, in euros. Delivery costs are not included in the prices displayed on our site. Any additional costs that may be charged to you are indicated before the contract is concluded.
Deliveries to countries outside the European Union may be subject to various charges and taxes, including customs and import VAT. These costs are borne exclusively by the buyer.
Delivery
Standard UPS home delivery.
Orders are dispatched the same day (orders placed before 3pm) or the day after your order is placed and the delivery time depends on the country of delivery.
Depending on the country you are in, delivery costs may vary. You can check the rates right here:
France : 15€ (2 to 3 working days) or free of charge from 100 euros of purchase
Switzerland :25€ (4 to 9 working days)
Europe : 25€ (4 to 9 business days)
Rest of the world : 40€ (10 to 15 working days)

Reservation of ownership
The transfer of ownership will take place after full payment of the price.
Transfer of risks
The transfer of risk of deterioration or loss of the goods shall take place upon receipt of the goods delivered.
Right of withdrawal
You have the right to withdraw from this Agreement without giving any reason within fourteen (14) days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail)

You can use this sample withdrawal form but it is not obligatory. In order for the withdrawal period to be respected, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period. You must return the goods to La Touche Française 4, rue du Bignon - ZA des longs réages - 22190 Plérin FRANCE, without undue delay and, in any event, no later than fourteen days after you have informed us of your decision to withdraw from this contract. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods.
Effects of withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will make the refund using the same method of payment as you used for the original transaction, unless you expressly agree to a different method; in any event, there will be no charge to you for the refund. We may defer the refund until we have received the goods or you have provided proof of dispatch of the goods, whichever is the earlier.
Exception to the right of withdrawal
The right of withdrawal is excluded for the following contracts:
- contracts for the supply of goods made to the consumer's specifications or clearly personalised;
- contracts for the supply of goods that are likely to deteriorate or expire rapidly;
- contracts for the supply of a newspaper, periodical or magazine, except for contracts for subscriptions to such publications;
- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
- contracts for the supply of goods which, after delivery, are by their nature inseparably mixed with other items;
- contracts for the supply of audio or video recordings or computer software where they have been unsealed by the consumer after delivery;
- contracts for the provision of services which have been fully performed before the end of the withdrawal period and where performance has begun after the consumer has given his prior express consent and expressly waived his right of withdrawal;
- contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal.
Legal guarantee
The legal guarantee applies under the conditions provided by law. The rights referred to in articles L.211-4, L.211-5, L.211-12 of the Consumer Code and articles 1641 and 1648 paragraph 1 of the Civil Code apply. Transfer of risks
The risk of deterioration or loss of the goods will pass when you take possession of the delivered goods or when the goods are handed over to a carrier commissioned by you, other than one of those offered on our site.
Photos
We make every effort to provide you with the most accurate representation of our products, including the colours of our products (light, white balance and colour profiles). However, the photos are not contractually binding. They are displayed correctly on a calibrated screen, but depending on your hardware configuration, the colour may be altered.
